I have a recording of a lecture or tutorial delivered by a guest lecturer. Can I upload these to Canvas?

Where a lecture or talk has been given by a guest lecturer, student or other third party, copyright will not rest with GSA but with the individuals in question. This remains the case even where those individuals have been paid to provide the lecture. Separate data protection legislation will also apply if the speaker is identifiable on screen. For this reason, you will need to seek express permission via a consent form from the individual before making their lecture available in Canvas. In addition, it may also be advisable to carry out a brief Data Protection Impact Assessment to ensure compliance with current data protection legislation.

Remember also that where a lecture incorporates third party material (such as images or music), these will carry their own copyright and separate permissions may need to be sought. Employ a risk-managed approach to this: where lots of materials are used in passing for illustrative purposes, and they are displayed in low resolution, it will not be practicable to clear copyright, and ‘fair dealing’ exemptions are likely to apply.
